Welcome to Her Patch Palace! These Terms of Service (the “Terms”) are a binding agreement between you and Her Patch Palace LLC (“Her Patch Palace,” “we,” “us,” or “our”) and govern your use of herpatchpalace.com, our content, and the products and services we offer (together, the “Services”). By browsing the Site or placing an order, you accept these Terms. We may revise the Terms by posting an updated version on this page; continued use of the Services after an update means you accept the revised Terms.

1. ELIGIBILITY

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use the Services. Our products are intended for adults only.

2. YOUR ACCOUNT

If you create an account, you agree to provide accurate, current information and keep it updated. You are responsible for safeguarding your login credentials and for all activity under your account. Tell us right away at Support@herpatchpalace.com if you suspect unauthorized use. We may suspend or close accounts that violate these Terms.

3. ORDERS, PRICING & PAYMENT

  • Your order is an offer to buy; a contract forms when we confirm and fulfill your order. We may refuse or cancel any order — for example, for suspected fraud, pricing or listing errors, or stock limits — and will refund anything you paid for a canceled order.
  • Prices, promotions, and product availability can change at any time without notice. If a product is listed at an obviously incorrect price, we may cancel the order and notify you.
  • Payment is collected at checkout through Shopify and our third-party payment processors. You authorize us to charge your chosen payment method for your order total, including taxes and shipping.
  • Discount codes cannot be combined unless we say otherwise, have no cash value, and may be changed or ended at any time.

4. SUBSCRIPTIONS & AUTO-RENEWAL

If you choose Subscribe & Save, you authorize us to charge your payment method automatically at the delivery frequency you select, at the subscription price shown at checkout, until you cancel. You can cancel or change your subscription at any time through your account or by emailing Support@herpatchpalace.com — cancellations take effect for any renewal order that has not yet been billed. Subscription pricing and discounts may change with advance notice to you.

5. SHIPPING

  • Orders are typically processed within 1–3 business days. Delivery dates shown at checkout or on the Site are estimates, not guarantees, and may be longer during holidays and promotions.
  • You are responsible for entering a complete, accurate shipping address. We are not responsible for orders delivered to the address you provided or for carrier delays.
  • Free-shipping offers apply only to order thresholds and regions stated on the Site and may change at any time.
  • International customers are responsible for any customs duties, taxes, and import fees.

6. RETURNS & REFUNDS

We stand behind our patches with a 30-day money-back guarantee. The full details — what is covered, how to make a claim, and how refunds are processed — are in our Return & Refund Policy, which is part of these Terms.

7. CONSENT TO BE CONTACTED

When you give us your email address or phone number, you agree that we may contact you electronically about your orders and account. Marketing emails and texts are sent only with your consent, which you may withdraw at any time (unsubscribe link, or reply STOP). Consent to marketing is never a condition of purchase.

8. INTELLECTUAL PROPERTY & ACCEPTABLE USE

The Site and everything on it — text, graphics, logos, product names, photos, videos, and page designs — belong to Her Patch Palace LLC or our licensors and are protected by trademark and copyright law. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Site for personal shopping. You agree not to:

  • copy, scrape, harvest, or republish Site content or data without our written permission;
  • use the Services for any unlawful purpose or in violation of these Terms;
  • interfere with the Site's operation, security, or other customers' use;
  • impersonate any person or misrepresent your affiliation with anyone;
  • purchase products for unauthorized resale.

9. REVIEWS & USER CONTENT

If you submit reviews, photos, comments, or other content, you grant Her Patch Palace a worldwide, royalty-free, perpetual license to use, reproduce, edit, and display that content in connection with our business (for example, on product pages and social media), credited by your first name or handle. You promise your content is yours, is accurate to your experience, and is not unlawful, misleading, or infringing. We may decline or remove content at our discretion.

10. PRODUCT INFORMATION & HEALTH DISCLAIMER

PLEASE READ THIS SECTION CAREFULLY.

  • Our patches are wellness products, not medicines. THESE STATEMENTS HAVE NOT BEEN EVALUATED BY THE FOOD AND DRUG ADMINISTRATION. OUR PRODUCTS ARE NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE.
  • Girl Sober Up and our other patches do not prevent intoxication, lower blood alcohol levels, or protect you from the effects of alcohol. Always drink responsibly, know your limits, and never drive or operate machinery after drinking.
  • Patches are for external use only. Do not use on broken or irritated skin, and discontinue use if irritation occurs.
  • Consult your physician before use if you are pregnant, nursing, taking medication, or managing a medical condition. Keep out of reach of children.
  • Product information on the Site is provided for general purposes and is not medical advice. Always read the label and packaging before use.

11. WARRANTIES & DISCLAIMER

You promise that the information you give us is accurate and that your use of the Services is lawful. Our 30-day guarantee (Section 6) is your exclusive remedy for dissatisfaction with a product. EXCEPT AS EXPRESSLY STATED IN THESE TERMS, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, HER PATCH PALACE LLC AND ITS OWNERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Some states do not allow certain limitations, so parts of this section may not apply to you.

13. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Her Patch Palace LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or third-party right. This obligation survives termination of these Terms.

14. THIRD-PARTY SERVICES

The Services may contain links to third-party websites and tools we do not control. We are not responsible for their content or practices, and these Terms create no rights for any third party.

15. FORCE MAJEURE

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, epidemics, labor disputes, carrier disruptions, war, or government action.

16. ASSIGNMENT

We may assign our rights and obligations under these Terms to an affiliate or successor without your consent. You may not assign yours without our written consent.

17. SEVERABILITY & NO WAIVER

If any provision of these Terms is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. Our delay in enforcing any right is not a waiver of that right.

18. GOVERNING LAW

These Terms and any dispute arising from them are governed by the laws of the United States and of the state in which Her Patch Palace LLC is organized and maintains its principal place of business, without regard to conflict-of-laws rules.

19. DISPUTE RESOLUTION & CLASS ACTION WAIVER

If you have a problem, please email Support@herpatchpalace.com first — most issues are resolved quickly and informally. If we cannot resolve a dispute within 30 days, you and Her Patch Palace agree that the dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court. YOU AND HER PATCH PALACE EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. You may opt out of this arbitration provision by emailing us within 30 days of your first purchase with the subject “Arbitration Opt-Out.”

20. ENTIRE AGREEMENT & NOTICES

These Terms, together with our Privacy Policy and Return & Refund Policy, are the entire agreement between you and Her Patch Palace about the Services and replace any prior understandings. We may give you notice by email, by posting on the Site, or by mail once our mailing address is published.
